1.- Introducción

La atención primaria de salud es el pilar fundamental del sistema sanitario, que actúa integrando la promoción de salud, la prevención y la asistencia en salud. Además, es el primer punto de contacto entre los ciudadanos y los servicios sanitarios. El vacío en la regulación legal de la profesión de la psicología sanitaria propicia la ausencia de Psicólogos Generales Sanitarios (PGS) en este nivel de atención, planteando desafíos sustanciales en el abordaje de las necesidades de salud mental de la población. En este contexto, se hace imperativo examinar detalladamente la situación actual y abogar por la inclusión de los PGS en la atención primaria.

El PGS ostenta el nivel 3 de MECES, que se corresponde con el nivel 7 del marco europeo. Esto es así porque para el ejercicio de la psicología en el sector sanitario es requisito legal tener formación del Grado de Psicología y además el Máster Universitario en Psicología General Sanitaria (de 90 créditos ECTS), según recogen la Disposición adicional séptima de la Ley 33/2011, de 4 de octubre¹ y la Orden ECD/1070/2013², de 12 de junio. Dicho máster existe desde 2014 y a raíz de la Disposición adicional sexta de la Ley 5/2011, de 29 de marzo³ se prevé el ejercicio de actividades sanitarias a aquellos psicólogos con formación de Licenciatura o Grado en Psicología y formación complementaria de posgrado anterior a la entrada en vigor del Máster Universitario en Psicología General Sanitaria.

En este sentido, desde el Ministerio de Sanidad se ha aclarado que los psicólogos habilitados como Psicólogos Generales Sanitarios pueden ejercer en idénticas condiciones a los que acceden a la profesión sanitaria a través del Máster habilitante en PGS.

2.- Desafíos actuales en la Psicología en España

El declive en el número de Psicólogos Especialistas en Psicología Clínica (PEPC) desde 1998 y la falta de reconocimiento de otras especialidades psicológicas revelan una preocupante crisis demográfica de profesionales especializados. Esta carencia limita la capacidad del sistema de salud para brindar una atención psicológica adaptada a diversas problemáticas psicológicas.

3.- Barreras Legales para los PGS en el Sistema Nacional de Salud (SNS)

La Ley 33/2011,  en el apartado 4 de su disposición adicional séptima, ha establecido restricciones que impiden que los PGS ejerzan en el SNS, contradiciendo el principio de integralidad en la prestación de servicios de salud. Esta limitación no solo contrasta con otras profesiones sanitarias y no sanitarias que trabajan en el sistema (fisioterapéutas, dietética y nutrición, trabajo social y educación social, entre otros), sino que, fundamentalmente dificulta el acceso a servicios de salud mental de calidad.

4.- Competencias y potencial de los Psicólogos General Sanitarios (PGS) en Atención Primaria

Los PGS están capacitados para abordar los diversos aspectos psicológicos que influyen en la salud general de las personas. Su capacidad para realizar diagnósticos, evaluaciones e intervenciones psicológicas los posiciona como profesionales clave en la atención primaria, donde la prevención y la atención temprana son esenciales. Esta capacidad, además de su reconocimiento legal a través del propio título habilitante en salud, ha sido confirmada jurisprudencialmente, entre otras, en la sentencia de la Audiencia Nacional de 3 de octubre de 2016 (nº resolución 372/2016), recogiendo qué:

  • “Los  Psicólogos Especialistas en Psicología Clínica no son los únicos que están habilitados profesionalmente para realizar diagnósticos, evaluaciones y tratamientos de la salud de las personas afectadas por trastornos cuyo examen corresponde al psicólogo y no a otras ramas de la salud como pueden ser los médicos especialistas en psiquiatría”.
  • “Entre las habilidades profesionales del Psicólogo Sanitario General se encuentra la de atender patologías que afectan a la salud de las personas desde un ámbito psicológico”…. “Es erróneo entender que corresponden de forma exclusiva a los Psicólogos especialistas en Psicología Clínica” (dicha atención). Ya el Tribunal Supremo en la sentencia dictada en fecha 25 de octubre de 2011 expuso que:
  • “Es principio transversal de la Ley 44/2003¹, de ordenación de las profesiones sanitarias, el que -todos- los profesionales sanitarios tienen como función general la tendente a la conservación, mantenimiento y restablecimiento de la salud de las personas atendidas por ellos, para lo que la propia ley acomete la definición de las funciones de cada una de dichas profesiones sin perjuicio de las funciones que, de acuerdo con su titulación y competencia específica corresponda desarrollar a cada profesional sanitario…”

5.- Necesidad de modificar la legislación actual

La exclusión de los PGS del Sistema Nacional de Salud (SNS) debido a la reserva de actividad para los PEPC, según la Ley 33/2011, ha generado barreras innecesarias y limitaciones en la prestación de servicios de salud mental. Para abordar esta cuestión, es crucial examinar de cerca los argumentos que respaldan la modificación de esta legislación restrictiva.

6. Argumentos Jurídicos a Favor de la Inclusión de los PGS en el SNS

La Ley 44/2003 reconoce a los Psicólogos Generales Sanitarios (PGS) la responsabilidad de prestar servicios necesarios en diferentes fases del proceso de atención integral de salud. Esta normativa respalda la inclusión de los PGS en la atención primaria, ya que sus competencias se alinean con las funciones generales de las profesiones sanitarias. La normativa establece que, sin menoscabo de las funciones específicas de cada profesional sanitario, estos deben contribuir a la conservación, mantenimiento y restablecimiento de la salud de las personas, promoviendo la integralidad en la atención.

La jurisprudencia, ejemplificada en la Sentencia del Tribunal Supremo de octubre de 2011, sostiene que no existe exclusividad en la adquisición de conocimientos para atender estados de salud y enfermedades. Esto respalda la idea de que la regulación actual puede ser revisada para permitir a los PGS contribuir de manera efectiva en el ámbito de la salud mental pública.

7.- Alineación de competencias con las necesidades de Atención Primaria

La descripción detallada de las competencias de los PGS, según la Ley 33/2011, señala claramente que están capacitados para atender aspectos psicológicos que influyen en la promoción y mejora del estado general de salud. En la sentencia de la  Audiencia Nacional con número de resolución 372/2016, (Sala de lo Contencioso-Administrativo, 6) de 3 de octubre de 2016 se señala no sólo la necesidad sino su competencia:  “Regulación ésta en la que se especifica claramente la necesidad de disponer del Máster y que entre las habilidades profesionales del Psicólogo General Sanitario se encuentra la de atender patologías que afectan a la salud de las personas desde un ámbito psicológico. Por tanto, no puede aceptarse la afirmación […] cuando sostiene que en los programas formativos del Psicólogo Sanitario General no pueden incluirse conocimientos para adquirir habilidades profesionales relacionadas con la salud, patologías mentales y pacientes puesto que es erróneo entender que corresponden de forma exclusiva a los Psicólogos” y añade: “Es principio transversal de la Ley 44/2003, de ordenación de las profesiones sanitarias, el que -todos- los profesionales sanitarios tienen como función general la tendente a la conservación, mantenimiento y restablecimiento de la salud de las personas atendidas por ellos, para lo que la propia ley acomete la definición de las funciones de cada una de dichas profesiones “sin perjuicio de las funciones que, de acuerdo con su titulación y competencia específica corresponda desarrollar a cada profesional sanitario, ni de las que puedan desarrollar otros profesionales”.

Este alineamiento con las necesidades de la atención primaria, donde la prevención y atención temprana son fundamentales, refuerza la necesidad de reconsiderar la legislación actual y permitir la inclusión de los PGS en este nivel.

Finalmente los magistrados también consideraban que: “existe una regulación propia de ambas ramas de la Psicología Sanitaria que permite reconocer que es válida la regulación examinada cuando establece que los conocimientos que deben adquirir con el Máster en Psicología Sanitaria General van dirigidos a procurar la salud de las personas lo que conlleva la posibilidad de realizar diagnósticos y evaluaciones en los supuestos de enfermedad.”

Sin embargo, como la creación del Psicólogo General Sanitario (Ley de Salud Pública 33/2011, disposición adicional séptima del 10/2011) fué posterior a la Ley Ordenación de Profesiones Sanitarias (Ley 44/2003), los magistrados resuelven que  ésta figura no puede ejercer en el SNS, ya que: “Los psicólogos que desarrollen su actividad en centros, establecimientos y servicios del Sistema Nacional de Salud o concertado con él, para hacer efectivas las prestaciones sanitarias derivadas de la cartera de servicios comunes del mismo que correspondan a dichos profesionales, deberán estar en posesión del título oficial de Psicólogo especialista en Psicología Clínica al que se refiere el apartado 3 del anexo I del Real Decreto 183/2008, de 8 de febrero, por el que se determinan y clasifican las especialidades en Ciencias de la Salud y desarrollan determinados aspectos del sistema de formación sanitaria especializada”, impidiendo así la incorporación del Psicólogo General Sanitario (PGS), generando así una incongruencia entre las necesidades actuales y recursos disponibles.

8. Experiencias exitosas de integración en otros países

Para la revisión de experiencias internacionales hemos incluído algunos países en los que los psicólogos que trabajan en el ámbito sanitario tienen una formación de grado + máster comparable a la de los PGS en España, dado que el PGS es una particularidad de nuestro estado y el ejercicio de la psicología en el sector sanitario no dota de una regulación a nivel europeo o internacional, sino que cada país tiene sus propias regulaciones. Los datos revelan que la inclusión de psicólogos con formación de Grado y Máster en la atención primaria ha tenido impactos positivos en el acceso a servicios de salud mental y la eficacia de las intervenciones. Adoptar enfoques similares podría proporcionar valiosas lecciones para fortalecer el sistema de salud mental en España.

Reino Unido: Modelo de Integración en Atención Primaria

En el Reino Unido, la incorporación exitosa de la Psicología General Sanitaria en la atención primaria ha demostrado ser un componente esencial en la respuesta a las necesidades de salud mental de la población. Los y las psicólogos/as con formación de grado + máster trabajan en estrecha colaboración con el personal médico y de enfermería, brindando intervenciones psicológicas tempranas y preventivas. Este enfoque ha contribuido significativamente a la detección temprana de trastornos mentales y a la reducción de las listas de espera en servicios especializados. Diversas publicaciones y estudios que incluyen el costo-efectividad sobre modelos de intervención que se recogen dentro del Programa Mejorar el Acceso a Terapias Psicológicas (IAPT) muestran cómo estas intervenciones, a través de la capacitación y el descenso de las listas de espera, han logrado reducir la medicalización de los problemas de salud mental y malestares emocionales, así como muestran una recuperación que ronda el 50%. Este tipo de intervenciones según  la revista científica Nature representan un estándar mundial.

Canadá: Ampliación del Rol en Atención Primaria

Esta figura profesional desempeña un papel fundamental en la evaluación, diagnóstico y tratamiento de problemas de salud mental en la comunidad. La accesibilidad mejorada y la atención integral ofrecida en la atención primaria han resultado en una mayor satisfacción del paciente y en una gestión más eficaz de las condiciones de salud mental.

 

Australia: Programas de Salud Mental en Atención Primaria

Australia ha implementado programas exitosos que integran PGS en la atención primaria, abordando no solo la atención clínica sino también programas de prevención y promoción de la salud mental. Estos programas se centran en la capacitación del personal de atención primaria para trabajar en colaboración con los y las psicólogos/as con formación de grado + máster, permitiendo una atención más holística y orientada a la comunidad. Uno de los programas más exitosos ha sido el denominado “New Access” para la depresión y ansiedad.

9.- Propuestas para la modificación de la legislación

Para superar las barreras actuales, se proponen acciones concretas, como eliminar la reserva de actividad que limita a los PGS en el SNS (punto 4 de la disposición adicional séptima de la Ley 33/2011) o añadiendo una disposición final cuarta que permitiera, junto con sus competencias ya reconocidas, su inclusión en la cartera de servicios comunes de atención primaria. Este cambio legislativo sería un paso significativo hacia un sistema de salud mental más inclusivo, equitativo y eficiente.

10.- Beneficios de la modificación legislativa

La inclusión de los PGS en el SNS no sólo abordaría la escasez de profesionales sino también mejoraría la accesibilidad y calidad de los servicios de salud mental, así como la prevención en el posible debut de trastornos mentales. Este paso contribuirá a una atención sanitaria más integral y centrada en las necesidades reales de la población, promoviendo el bienestar mental y físico de manera holística, y con un enfoque comunitario, contemplando la salud mental como el resultado de la interacción entre las características individuales y los determinantes en salud, según los ejes de desigualdad presentes en nuestra sociedad.

Esto favorece la promoción del bienestar integral de la población, alineándose con los principios fundamentales de la Ley 44/2003 y respondiendo de manera efectiva a las crecientes demandas en salud mental en la sociedad actual. Además, permitiría alcanzar la recomendación de la Unión Europea, de 18 psicólogos por cada 100.000 habitantes. Esta recomendación no concreta específicamente la figura del Psicólogo Clínico, precisamente por la particularidad/singularidad de la formación que se requiere en España para trabajar en el SNS en esta disciplina en concreto (el resto de profesiones sí son homologables).

11. Conclusión y llamada a la acción

Ante esta realidad, se propone la incorporación de los PGS como parte integral de los equipos de atención primaria como medida crucial para maximizar sus competencias. 

En conclusión, modificar la legislación actual para permitir la participación activa de los PGS, tanto vía máster como vía habilitación, en el Sistema Nacional de Salud es una necesidad inminente e imperiosa. Este cambio no solo fortalecerá la respuesta del sistema a las demandas de salud mental, sino que también garantizará la integralidad y equidad en la atención sanitaria. Es imperativo que los actores relevantes consideren esta propuesta y actúen en consecuencia para lograr un sistema de salud más inclusivo y centrado en las necesidades de la población.

Desde hace mucho tiempo, la tecnología se ha utilizado dentro de las sesiones en psicología y psiquiatría. El primer estudio que se publicó relacionado con el uso de realidad virtual en terapia data de 1995 y, desde entonces, numerosos estudios en el campo de la psicología se han centrado en el uso de la realidad virtual, especialmente, para el tratamiento de los trastornos de ansiedad, ofreciendo resultados muy buenos en cuanto a eficacia de la terapia y mejora de la sintomatología de los/as pacientes.

Otro uso muy común de la TIC en sesiones terapéuticas se da en el uso de pruebas y cuestionarios de evaluación. La mayoría de pruebas diagnósticas tienen la posibilidad de aplicación y corrección online, posibilitando una más rápida y eficiente interpretación de los resultados.

Pero, no es lo mismo utilizar las TIC dentro las sesiones en la terapia presencial, que realizar sesiones de psicología online.

Con el inicio de la pandemia por la COVID-19, se impuso el teletrabajo en empresas y sectores en los que antes no se había planteado o su uso era muy limitado y, muchos/as profesionales del área de la psicología, también tuvimos que actualizarnos en este sentido. Si bien es cierto que la terapia online lleva varios años en funcionamiento, a raíz del confinamiento que sufrimos en marzo de 2020, el uso de las sesiones de terapia online se ha visto disparado.

En los últimos años, numerosos estudios han confirmado la eficacia de la terapia online para diversos problemas y dificultades como la ansiedad, la depresión, el trastorno obsesivo compulsivo, los trastornos por estrés, dificultades y problemas de sueño, adicciones… y se ha utilizado de diversas formas, ya sea como parte de una terapia o seguimiento, alternativa puntual a la sesión presencial, o como una opción terapéutica al completo.

En este sentido, será importante plantearnos diferentes cuestiones:

¿Qué ventajas e inconvenientes tiene la terapia online?, ¿cualquier paciente es apto para su realización?, ¿cualquier trastorno o dificultad puede ser tratado de forma online?, ¿qué variables tengo que tener en cuenta que pueden influir en los resultados?

Puntos fuertes y reticencias sobre la terapia online

La terapia online cuenta con claros puntos fuertes que podemos tener en consideración:

  • Accesibilidad: Permite el acceso al trabajo psicológico a personas con restricciones de tiempo y de desplazamiento. Podría beneficiar a diversos sectores de la población, personas con dificultad de movilidad, población rural… permitiendo un mejor acceso al eliminar la variable distancia.
  • Especificidad de la atención: Se facilita el acceso a determinados centros y/o especialistas que no encontramos cerca de nuestro lugar de residencia.
  • Eficacia y rentabilidad: Además de reducir el tiempo empleado en acudir a sesión, puede suponer la reducción del coste que supone el desplazamiento para personas que viven alejadas de la consulta de psicología.

Considerando las fortalezas anteriores de la terapia online, bien es cierto que todavía existen reticencias y puede presentar dificultades a la hora de ponerla en funcionamiento:

  • Desconocimiento: No todas las personas poseen el conocimiento necesario de los recursos electrónicos o cuentan con la tecnología adecuada.
  • Confidencialidad: Tener sesiones de psicología online supone un riesgo en la protección de datos y la confidencialidad si no se utilizan las plataformas adecuadas.
  • Escasa formación: Puede existir un rechazo por parte de los psicólogos y psicólogas al no tener una formación específica para llevar a cabo una terapia online, además de no contar con las habilidades informáticas necesarias.
  • Prejuicios y resistencias: Es posible que los/as pacientes no le den a la terapia online la misma credibilidad o validez que tiene la terapia presencial.
  • Ausencia de proximidad física: Lo que podría influir en la calidez de la relación terapéutica.

¿Es viable la terapia online en mi caso?

Conociendo esta serie de ventajas y desventajas de este tipo de terapia, si tenemos pensado ofrecer sesiones de psicología online a nuestros pacientes, es necesario que consideremos las siguientes variables que aseguren la absoluta viabilidad y eficacia de la intervención.

  • Entrenamiento profesional: Es necesario que los profesionales adquiramos conocimientos y nos familiaricemos con la tecnología a utilizar. Somos nosotros los primeros que debemos tener conocimientos sobre la plataforma a usar, posibilidades de compartir información y dispositivos compatibles. La seguridad del terapeuta en el uso de la plataforma online y su preparación en ella, es indispensable para este tipo de terapia.
  • Valorar la idoneidad del paciente: Son importantes aspectos como su edad, sus conocimientos sobre las TIC, su capacidad atencional y su conformidad en la realización de este tipo de terapias, además de valorar si el diagnóstico y problemática del paciente, hacen posible su uso.
  • Asegurar una adecuada alianza terapéutica: Múltiples investigaciones demuestran que la creación de una adecuada alianza terapéutica constituye aproximadamente la mitad de la mejora sintomática. Es una relación única, la base sobre la que construimos la terapia. Mientras que, en un principio, debe existir una sensación de apoyo, aceptación y ayuda por parte del paciente, a medida que avanza el proceso debe de plasmarse en un trabajo conjunto de negociación y de sentimiento de pertenencia.
  • Contexto terapéutico funcional: Debemos configurar un ambiente adecuado, es decir, cualquier lugar no nos sirve como espacio terapéutico para la terapia online. Un despacho o un lugar exclusivamente dedicado para la terapia transmite la seriedad e idoneidad necesarias para llevar a cabo las sesiones online. Debemos contar con una iluminación adecuada, dejar fuera determinados estímulos distractores para nuestros/as pacientes y asegurar una visión nítida que facilite el contacto ocular. De la misma forma, el/la paciente también debe disponer de un espacio tranquilo donde disponga de la suficiente intimidad.
  • Encuadre terapéutico claro: Al igual que en la terapia presencial, es necesario aclarar el tiempo y la periodicidad de las sesiones, honorarios y posibles formas de contacto.
  • Viabilidad tecnológica: Es necesario tener una conexión adecuada, cámara que asegure una buena visión, micrófono/auriculares que facilite la comunicación y escucha, además de tener clara una alternativa a los problemas de conexión puntuales (modificación de cita, continuación telefónica…).
  • Recursos materiales accesibles: Debemos elaborar el material de forma que se pueda compartir a través de la pantalla. En esta ocasión, el papel y boli para trabajar con el paciente, tan necesario en las sesiones y psicoeducaciones, debe sustituirse por materiales y documentación que se pueda compartir de manera sencilla a través de la plataforma para las sesiones online o a través de otros medios digitales.
  • Plataformas seguras: Es especialmente importante contar con una plataforma web que cumpla con los requisitos de confidencialidad y protección de datos. En este caso el Consejo General de Psicología de España y los diferentes Colegios profesionales autonómicos, ponen a disposición de los psicólogos/as colegiados/as, diferentes softwares de gestión de videoconferencias encriptadas que cumplen con la ley oficial de protección de datos.

Por todas estas variables comentadas, como psicólogos y psicólogas, podemos hacernos determinadas preguntas que nos ayuden a implementar y comprobar la viabilidad de la terapia online para llevar a cabo las sesiones terapéuticas:

  • ¿Tengo la formación adecuada para realizar terapia online?
  • ¿Dispongo de un lugar adecuado para realizar las sesiones a través de videoconferencia?
  • ¿Dispongo de un equipo tecnológico adecuado?
  • ¿Mi paciente se adapta adecuadamente a las sesiones online?
  • ¿Hemos conseguido establecer un vínculo adecuado con él/ella?
  • ¿Se adhiere a las tareas y ejercicios entre sesiones planteadas?
  • ¿No existe ninguna barrera de comunicación que dificulte las sesiones?

Mi experiencia personal

Como experiencia personal, tras llevar varios años trabajando en mi despacho de forma presencial y sin plantearme alternativas para poner en marcha una terapia psicológica online, en marzo de 2020, llegó la COVID-19 y el correspondiente confinamiento.

Todos y todas tuvimos que reinventarnos y ofrecer a los/as pacientes alternativas adecuadas para continuar su intervención psicológica.

A partir de ese momento, creo que la terapia online ha llegado para quedarse como parte de mi vida laboral y, hoy en día, además de las sesiones presenciales, mantengo sesiones online para diferentes pacientes y situaciones, como pueden ser los seguimientos para pacientes que no viven en mi localidad, sesiones para estudiantes que pasan la semana fuera de su casa familiar, sesiones puntuales por dificultades de desplazamiento y terapias psicológicas al completo para aquellos pacientes que prefieren la metodología online en su proceso.
