Consentimiento informado en menores: un imprescindible en psicología sanitaria

El consentimiento informado es un aspecto básico de nuestro trabajo como profesionales de la psicología en el ámbito sanitario. Sin embargo, cuando trabajamos con menores, se hace todavía más imprescindible. En este artículo explicamos cómo y cuándo debemos aplicarlo.

 

¿Qué es el consentimiento informado?

La Ley Básica Reguladora de la Autonomía del Paciente y de Derechos y Obligaciones en Materia de Información y Documentación Clínica define el consentimiento informado como:

“la conformidad libre, voluntaria y consciente de un paciente, manifestada en el pleno uso de sus facultades después de recibir la información adecuada, para que tenga lugar una actuación que afecta a su salud”.

Al ser los PGS profesionales sanitarios, es necesario que aportemos a nuestros pacientes toda la información que necesitan para decidir libremente si la terapia o intervención psicológica que van a recibir es la adecuada para ellos. Algunos de los datos que podemos aportar son:

  • Funcionamiento de las sesiones (duración, periodicidad, honorarios, política de cancelación o cambios…)
  • Política de protección de datos
  • Derechos que tiene como paciente

El consentimiento informado puede ser oral o presentarse por escrito. Elijas la modalidad que elijas, lo más importante es que la persona con la que vas a comenzar la terapia tenga claro todo lo que implica iniciar un proceso terapéutico, y esté de acuerdo con ello.

Pero, ¿qué ocurre cuando la persona con la que estamos trabajado es un menor de edad?

El consentimiento informado en menores

Cuando trabajamos con niños y niñas, no podemos olvidar que son también personas, y que tienen, al igual que los adultos, el derecho a ser informados sobre su terapia y a ser escuchados y que su opinión se tenga en cuenta para el desarrollo de la misma.

No obstante, según la edad que tengan, tenemos también la obligación de que sus progenitores (ambos) den su consentimiento para que la terapia se realice. Aunque puede prestarse de forma oral, al trabajar con niños y niñas es recomendable presentar el consentimiento por escrito.

A continuación, vamos a analizar cómo afrontar cada caso en función de la edad del menor.

Menores de 12 años

En el caso de los niños y niñas más pequeños, necesitamos que sean los padres (o tutores) los que nos presten su consentimiento informado, a pesar de que se cuente con la opinión del niño y se le informe de todo el proceso de una manera adaptada a su capacidad de comprensión. La ley no les presume capacidad de elección en este caso, por lo que es imprescindible tener este consentimiento informado de sus progenitores (Del Río, 2010).

Menores a partir de 16 años

En España, los 16 años suponen la mayoría de edad sanitaria. Por lo tanto, el menor puede tomar decisiones sanitarias por sí mismo, sin necesitar la autorización paterna o materna. Así pues, el consentimiento informado debe darlo él, aunque siempre es preferible contar también con el apoyo de sus padres.

Menores entre 12 y 16 años

En esta franja de edad es donde nos surgen más dudas. Aunque la decisión corresponde a los padres, hay obligación de tener en cuenta la opinión de los menores y de valorar su capacidad de juicio. Pero, ¿qué quiere decir que valoremos su capacidad de juicio?

Según la doctrina del menor maduro, los derechos fundamentales pueden ser ejercidos por la persona desde el mismo momento en que es lo suficientemente madura para ello (Del Río, 2010), aunque no haya cumplido aún los 18 años.

Por este motivo, cuando trabajamos con menores entre 12 y 16 años es importante que valoremos, mediante entrevistas clínicas (o incluso algún cuestionario si lo valoramos pertinente), la capacidad que tienen para: tomar decisiones relevantes, resolver problemas, reconocer errores, manejar sus emociones, asimilar la información que recibe…Tras esta valoración de la madurez y/o juicio del menor, podemos encontrarnos con dos supuestos:

 

  • Que consideremos que el menor es un menor maduro: en este caso, será él el que preste el consentimiento informado y se respetarán sus decisiones con respecto a la terapia, aunque como hemos comentado antes, siempre es recomendable que también los padres participen en el proceso.
  • Que consideremos que el menor no es maduro: si valoramos que el menor no tiene la suficiente madurez, serán los progenitores los que deban dar su consentimiento para la intervención.

Situaciones conflictivas

Normalmente, suelen darse situaciones conflictivas cuando se interviene con menores sin capacidad plena para prestar el consentimiento cuyas familias se encuentran en situación de conflictividad (separación o divorcio).

En estos casos, lo primero que tenemos que saber es si ambos progenitores cuentan con la patria potestad del menor. Si es así, hay que ser rigurosos y cautelosos, puesto que necesitamos que el consentimiento informado sea otorgado tanto por el padre como por la madre, aunque solo uno de ellos sea el que ha traído al pequeño a nuestra consulta. Por lo tanto, tendremos que ponernos en contacto con el otro progenitor e informarle de en qué va a consistir nuestra terapia. Si no existe acuerdo entre ambos y no se cuenta con el consentimiento de uno de ellos, no es posible continuar con el proceso terapéutico.

Contamos con dos excepciones para estos casos:

  • Que exista una autorización judicial para que solamente uno de los progenitores preste el consentimiento (por ejemplo, en casos en que haya un procedimiento judicial abierto contra uno de ellos).
  • Que el psicólogo considere que los padres están realizando un ejercicio abusivo de su patria potestad (por ejemplo, negándole al niño un tratamiento que necesita y que se ha comprobado que es eficaz). En este caso, es recomendable acudir al colegio de psicólogos para que nos asesoren legalmente sobre cuáles son los pasos a seguir.

¿Qué aspectos debemos tener en cuenta en la primera entrevista con cualquier paciente que venga a nuestra consulta? ¿Qué temas deberíamos tocar “sí o sí”? ¿Qué no deberíamos hacer en ningún caso? Es difícil unificar todas estas pautas en un protocolo general, ya que “cada maestrillo tiene su librillo”. La importancia de la alianza terapéutica

Cualquier profesional de la Psicología conoce la importancia del primer contacto con nuestro paciente, ya que es en este momento cuando se construyen las bases de la relación terapeuta-paciente. Si el paciente no se siente cómodo, disminuirán las probabilidades de que vuelva en la siguiente sesión, y de esa manera no le podremos ayudar. Así, el objetivo principal de la primera sesión va a ser crear un ambiente suficientemente seguro como para que el paciente quiera volver. ¿Sirve de algo realizar muchas preguntas y recoger toda la información posible, si el paciente no vuelve nunca más?

Durante toda la sesión es importante crear una buena relación terapéutica, a lo que muchos psicólogos llaman, el “rapport inicial”. El término rapport viene del francés “rapporter” y significa “crear una relación” o “traer de vuelta” (Escaño, 2019). Este concepto de rapport, o alianza terapéutica, fue desarrollado durante el siglo XX  por Freud, quien en su trabajo The Dynamics of Transference (1912) ya expuso que para que analista y paciente puedan establecer una relación positiva, es importante que el profesional muestre interés y una actitud comprensiva. A veces se pasa por alto la relevancia de crear este clima de confianza. La evaluación psicológica y las técnicas de tratamiento son sumamente importantes para la mejoría del paciente, así tanto como que éste confíe en nosotros plenamente y se sienta motivado para seguir el tratamiento. Se estima que un gran porcentaje del éxito de los tratamientos psicológicos se debe a una alianza terapéutica de calidad, existiendo una relación positiva entre esta alianza y los resultados de la terapia (Flückiger, Del Re, Wampold y Horvath, 2018).

Diversos autores han intentado reunir las características principales que debe tener la relación terapéutica. Bordin (1979) identificó tres elementos que componen la alianza terapéutica:

  • el vínculo positivo
  • el acuerdo en los objetivos entre paciente y terapeuta
  • el acuerdo en las tareas

No hay que olvidar las habilidades terapéuticas, como la escucha activa, la calidez y la empatía, que son necesarias para crear ese clima de confianza y mantenerlo durante todas las sesiones posteriores.

¿Cómo abordar los primeros momentos?

Técnicas más específicas de los primeros momentos de la sesión pueden ser mantener una breve conversación informal para romper el hielo. ¿Y si empiezas con un “¿qué tal?, ¿has encontrado fácilmente la consulta?”, en vez de empezar a hacer preguntas rápidamente?

Tras mantener una breve conversación para romper el hielo, pasaremos a realizar el encuadre terapéutico. Conviene explicar algunos aspectos básicos al paciente para que éste gane seguridad. Es importante dar información sobre nosotros mismos y sobre cómo va a ser la terapia. Cuanta más información disponga el paciente, más sensación de control va a experimentar, y con ello, más relajación para abrirse a nosotros. Algunos aspectos básicos a explicar son: confidencialidad, honorarios, tiempo de las sesiones, como van a ser las sesiones (inicialmente evaluación y más adelante tratamiento), explicar nuestra formación, etc.

Conociendo más a nuestro paciente

A continuación procederemos a recoger información sobre la vida del paciente. Intentaremos, en la medida de lo posible, realizar preguntas abiertas, para intentar así que el paciente hable más, y con ello obtener más cantidad de información.

Aspectos de la vida del paciente que no podemos olvidar son:

  • Datos demográficos (edad, procedencia, estado civil, etc)
  • Área laboral
  • Información sobre su alimentación y sueño
  • Estado general de salud
  • Aficiones
  • Vida social (relaciones de amistad, pareja)
  • Información sobre su familia (genograma, antecedentes psiquiátricos familiares, relación con cada uno de ellos…)
  • Consumo de drogas

Es importante que nunca empecemos a preguntar ni cambiar de tema bruscamente sin avisar previamente al paciente.

Una herramienta de gran utilidad para recoger toda esta información es la “Línea de vida”. Se trata de plasmar gráficamente la vida del usuario, desde su nacimiento, hasta el momento presente. El objetivo de esta técnica es ordenar y recoger los acontecimientos más relevantes de la vida del paciente, así como la psicopatología que ha podido presentar a lo largo de su vida. Ésta técnica, al ser gráfica, nos ayuda a visualizar fácilmente y poder unir acontecimientos de la vida de nuestro paciente, para poder explicar el origen y mantenimiento de la psicopatología presente.

¿Qué nos ha traído aquí?

Cabe diferenciar como un punto a parte el motivo de consulta del paciente. Seguramente, durante toda la entrevista, nuestro paciente nos ha ido dando información sobre qué le ocurre, sobre su estado de ánimo, sobre sus problemas, etc. Aun así, es idóneo preguntarle explícitamente sobre el problema que más malestar le está causando actualmente, y sobre que es lo que le ha llevado a pedir ayuda en “este preciso momento”.

Del motivo de consulta de nuestro paciente, van a derivar los objetivos terapéuticos que acordemos con él, en definitiva, ¿qué es lo que nuestro paciente espera de nosotros?, ¿en qué cree que le podemos ayudar? La respuesta a estas preguntas es lo que nos va a permitir conectar con sus necesidades, y conseguir así nuestro objetivo: “que vuelva” si lo necesita.

Antes de concluir la sesión

Para terminar, y no menos importante, debemos devolver la información al paciente. Hacer un resumen de la sesión, así como pactar la siguiente, va a ser nuestro punto de conexión con él.

Es conveniente que el paciente tenga alguna tarea sencilla que realizar durante la semana (rellenar algún test, técnicas de relajación, autorregistro, etc.), para aumentar su compromiso hacia nosotros cuando no estamos presentes. Aquí es conveniente volver a utilizar la conversación informal, para crear un clima amable, y aprovechar así el efecto de recencia, el cual indica que la información facilitada al final es la que mejor recordamos, posiblemente por su almacenamiento y presencia en la memoria a corto plazo (Baddeley, 2003).

Dar las gracias al paciente, reforzar por su valentía y confianza. Si conocemos algún aspecto que le gusta, podemos aprovecharlo para charlar sobre ello. Algunas preguntas para este momento pueden ser: ¿Cómo te has sentido? ¿Tienes alguna duda, quieres preguntarme algo?, ¿estás menos nervioso/a?

Recuerda: ¡sé tú mismo!

Como conclusión final, recalcar que siempre debe existir flexibilidad en el guión de la entrevista, para poder adaptarlo así a las respuestas del paciente. Un equilibrio entre preguntar y nuestro objetivo principal (que el paciente vuelva). En este sentido, la primera sesión es crítica, ya que en este primer momento debemos invertir más esfuerzo en adaptarnos a la persona que tenemos delante y que acabamos de conocer.

En el intento de adaptarnos a nuestro paciente, no debemos perder nuestra esencia personal. Debemos ser fieles a nosotros mismos, ya que el éxito de nuestro trabajo radica en la autenticidad. En este sentido, cada uno de nosotros tiene un “estilo personal”. Hay profesionales más cálidos, otros con más sentido del humor, etc. De esta manera, habrá pacientes que cuadren a la perfección con nosotros, y otros que debamos derivar a otro psicoterapeuta. Así, todos los profesionales del ámbito de la Psicología debemos hacernos la siguiente pregunta, y reflexionar sobre ello: ¿Cómo somos como terapeutas?

Desde nuestra autenticidad y gran capacidad de adaptación, podremos aprender a explotar todo nuestro potencial como Profesionales de la Psicología.
